Protection of customers’ personal data
MSTYLING, Mitja Paldauf s.p. (hereinafter “MSTYLING”) pays great attention to the protection of personal data. This document sets out which personal data we process, in particular about our customers and the users of our online shop, whether we process this data on the basis of consent given or on another legal basis, for which specific purposes we use it, to whom we may pass it on and what your rights are in relation to the processing of your personal data.
What personal data do we process?
When you use our services, we collect various types of data about you, such as your username and password, your contact details and other settings. We keep track of which items you view in our online shop, on which device, and which of the offers we send by e-mail have interested you. On this basis we create additional data so that we can send you offers tailored to your wishes and further improve our online shop and services in future. If you make a purchase from us or create an account, we also process your first name and surname, your orders and the data you set in your account.
We process the following personal data:
- identification data, mainly comprising your first name and surname, username and password, and your VAT ID if you are a legal entity;
- contact details, comprising the personal data we can use to get in touch with you, mainly your e-mail address, telephone number, delivery address, billing address and your social media profiles;
- your settings, comprising data about your account, mainly saved delivery addresses, profiles, newsletter subscriptions, shopping lists, and your ratings and comments on items and services;
- data about your orders, mainly comprising data about the items ordered and the payment method, including your bank account number, and data about complaints;
- data about your online habits, including when you browse via our mobile app, mainly data about the items and services you search for, the links you click on, how you search and move around our website, and data about the devices you use to access the internet, such as your IP address and the associated location, the device ID and its technical parameters, such as the operating system, version, screen resolution, selected browser and its version, as well as data obtained from cookies and similar device recognition technologies;
- derived data, which includes personal data obtained from your settings, data about the items you buy from us, and data about your online habits and behaviour in connection with reading the messages we send you; this mainly concerns data about gender, age, financial situation, consumer habits and attitudes towards various items and services;
Why do we process personal data and why are we entitled to do so?
We process your personal data in different situations for different purposes. If you visit the pages of our online shop, on which we also use cookies, we use your data mainly to determine the number of visitors and to improve our services.
If you are registered with us, we use your data to manage your account and provide the related features. If you make a purchase from us, we use your data to process your order, protect our legal claims and fulfil our legal obligations. With the help of your contact details and other data, we can also show and send you our personalised offers.
With your consent, we pass data on to third parties to display offers on other websites and to give you access to certain additional services. We are entitled to process your personal data on the basis of preparing or performing a contract with you, complying with legal obligations, our legitimate claims or your consent.
In the course of our business, we process personal data for various purposes and to varying extents, namely: without your consent on the basis of performing a contract, our legitimate interest or for the purpose of fulfilling legal obligations, or on the basis of your consent.
What processing we may carry out without your consent depends on the purpose the processing serves and on your relationship with us – whether you are just a visitor to our online shop, register with us or buy something. We may also process your data if you are the recipient of goods or services ordered from us, if you communicate with us or if you visit our collection point.
Processing on the basis of performing a contract
If you create an account at mstyling.net, we process your identification and contact details, your settings and data about your orders (if you later make a purchase from us) on the basis of performing a contract with you (without your consent), so that we can manage your user account. The contract on which our processing is based is formed at the same time as your account. We use personal data for this purpose for as long as your account exists, and you can delete it at any time.
If you make a purchase from us, the processing of data is extended as follows:
Processing on the basis of performing a contract
If you make a purchase from us as a natural person, we process your personal data for the purpose of processing your order. This concerns identification and contact details and data about your orders. If you have a user account with us, we may also use your settings for this purpose.
If you make a purchase from us as the representative of a legal entity, we process the same data for the same purpose on the basis of our legitimate interest, which is based on concluding and performing a contract with the entity you represent.
Using data for the purpose of processing your order means that we use the data specifically for:
- enabling you to complete your order online, i.e. so that, for example, the items you have added to your basket or the data from an order in progress are not deleted;
- enabling us to communicate with you, e.g. sending order confirmations or notifying you that items have been dispatched;
- the purposes of payment for the goods,
- the purposes of delivering the goods; in this connection we may also pass your data on to our transport partners, exclusively for the purpose of delivering these goods.
For this purpose, we use personal data for the time strictly necessary to process your order or settle contractual obligations, such as complaints.
Processing on the basis of fulfilling legal obligations
We too must fulfil certain obligations laid down by law. If we process your personal data for this reason, we do not need your consent for such processing. On this legal basis, we process your identification and contact details and order data in order to comply with the laws in force at any given time, which at the time this memorandum was drawn up are in particular the following
- Obligations Code (OZ),
- Consumer Protection Act (ZVPot),
- Value Added Tax Act (ZDDV-1),
- Fiscal Verification of Invoices Act (ZDavPR),
- Accounting Act (ZR),
- Electronic Communications Act (ZEKom),
- Prevention of Money Laundering and Terrorist Financing Act (ZPPDFT-1).
For this purpose, we use personal data for a maximum of 10 years (plus the current year) after the last document issued in connection with your order.
If you communicate with us through various channels:
If you communicate with us through various channels, in particular call centres, e-mail, chat and social media, we process your identification and contact details and records of our communication on the basis of our legitimate interest (i.e. without your consent) for the purposes of:
processing your requests; if you have made a purchase from us and your request relates to an order, we may carry out the processing on the basis of performing a contract with you;
keeping a record of your requests so that we can check that they are dealt with properly and on time;
proving that we have received and processed your request, e.g. if you order goods or make a complaint in this way;
analysing requests to improve the quality of our services.
For these purposes we keep personal data for a period of 3 months. If you place an order through one of our channels, we may keep the data to protect legal claims for the limitation period of 5 years plus 1 year after its expiry in relation to claims asserted at the end of the limitation period. In the event of legal, administrative or other proceedings, we process your personal data to the extent necessary for the duration of such proceedings and for the remainder of the limitation period after they end.
If you have any concerns about such processing on the basis of legitimate interest, please contact us.
If you visit our collection point or its surroundings:
If you visit our collection point or its surroundings, we process recordings from the CCTV system in which you may appear, on the basis of our legitimate interest (i.e. without your consent), for the purpose of protecting our property and yours and the people moving around the shop and its surroundings, which is also our legitimate interest.
For this purpose we keep personal data for a period of 2 months.
If you have any concerns about this, please contact us.
Who processes your personal data and with whom do we share it?
In most cases, we process your data for our own purposes as its controller. In such cases, we pass your data on to our partners for payments, transport and other matters related to your order. We also pass data on to our processors, who process it in accordance with our instructions.
We process all the personal data described as the controller. This means that we determine the purposes defined above for which your personal data is collected and the means of processing, and we are responsible for carrying it out properly.
We may also pass your personal data on to other entities that also act as controllers, namely:
in connection with processing your order, to our partners involved in processing the order, as stated in the section If you make a purchase from us, specifically
partners operating payment systems to provide payments, in particular in connection with payment cards; transport partners, in particular Pošta Slovenije d.o.o., Slomškov trg 10, 2500 Maribor, Slovenia, tax no. 25028022 and DPD d.o.o., Celovška cesta 492, 1210 Ljubljana-Šentvid, Slovenia, tax no. SI46749845, if they deliver the goods you have ordered;
the supplier of the goods or the service centre of the relevant manufacturer in connection with a complaint about the goods or service ordered;
From which sources do we obtain personal data?
We mostly obtain personal data directly from you through our online shop or when communicating with you. However, we may also receive some other data from our partners, e.g. banks or transport companies.
We mostly process personal data that you provide directly when ordering items and services, when creating and using an account or when communicating with us, for example with the call centre. We also obtain personal data directly from you by monitoring your online habits while you browse our online shop or read our messages, and from CCTV recordings in our business premises and their surroundings.
If you make a purchase from us, in connection with performing the sales contract concluded we may receive additional data about your orders from banks, our partners operating payment systems and transport partners, e.g. data about your account number, successful payments, or the delivery and receipt of goods.
What are your rights in relation to the processing of personal data?
You have a number of rights in relation to your personal data. These include the right of access, review, erasure and restriction of processing, portability, objection and complaint.
Just as we have our own rights and obligations regarding the processing of your personal data, you also have certain rights in relation to the processing of your personal data. These rights include:
Right to be informed
Put simply, you have the right to know what data we collect about you, for what purposes and for how long, where we obtain your personal data from, to whom we pass it on, who else processes it besides us and what your other rights are in relation to the processing of your personal data. If you are not entirely sure which personal data we collect about you, you can ask us to confirm whether or not we collect personal data relating to you and, if we do, you have the right to access this data. In line with the right of access, you can ask us for a copy of the data processed; we will provide the first copy free of charge and any further copies for a fee.
Right to rectification
To err is human. If you notice that the personal data we hold about you is incorrect or incomplete, you have the right to ask us to correct or complete it as soon as possible.
Right to erasure
In some cases you have the right to have your personal data erased. We will erase your personal data as soon as possible if one of the following grounds applies:
- we no longer need your personal data for the purposes for which we processed it;
- you have withdrawn your consent to the processing of personal data, where the data is such that your consent is required for its processing, and we have no other grounds for further processing of this data;
- you have exercised your right to object to the processing of personal data that we process on the basis of our legitimate interest, and we find that we no longer have legitimate interests justifying further processing of this data, or
- you believe that the processing of personal data we carry out is no longer in accordance with generally binding legal regulations.
Please be aware, however, that even if one of the grounds described applies, this does not mean that all your personal data will be erased immediately. This right cannot be exercised if the processing of your personal data is still necessary to fulfil our legal obligations or to establish, exercise or defend our legal claims.
Right to restriction of processing
In some cases, in addition to the right to erasure, you can also exercise the right to restriction of processing of personal data. This right allows you, in certain cases, to request that your personal data be specially marked and excluded from any processing operations – in this case the effect is limited in time (and not permanent, as with the right to erasure). We must restrict the processing of personal data:
- if you contest the accuracy of the personal data, until we agree which data is correct
- if we process your personal data without an appropriate legal basis (e.g. beyond the intended scope), but instead of erasure of such data you prefer only its restriction (e.g.
- if you expect to provide us with this data in future anyway);
- if we no longer need your personal data for the purposes described above, but you need it to establish, exercise or defend your legal claims, or
- if you object to the processing of data. While your objection is being considered, we must restrict the processing of your personal data.
